MEDIA STATEMENT BY WONG TACK, BENTONG MP ON 31 JANUARY, 2020.

1. With the intention to pacify their shareholders, Lynas has made an irresponsible announcement yesterday which has caused unnecessary anxiety to the people of Kuantan.

2. In their announcement Lynas says :

i) the Pahang government has approved Bukit Ketam as the site to build a PDF to dump more than a million tons of Lynas’ toxic radioactive wastes.

My question is how did the location to build the biggest radioactive dumpsite in the world got approved without a Detailed Environmental Impact Assessment (DEIA) and public consultation?

ii) they will only pay a maximum of USD98 million for the construction and operations of their massive radioactive waste dump. The final payment will be made in 2026. Not a single sen will be paid by Lynas thereafter.

My question is who will end up paying for the monitoring and maintenance of Lynas’ radioactive dump after that? Our children and future generations? And for how long? Millions of years?

iii) they intend to withdraw the USD50 million security deposit that they have placed with the AELB to partially finance the construction and operations of their radioactive dump.

This absurd move by Lynas should be a cause of serious concern for all Malaysians as it proves that Lynas is financially incapable to deal with their massive pile of radioactive wastes.

In any responsible country, deposits such as this is required to ensure that the polluter cleans up after they packed up. It is important to note that after Lynas shuts down, the decommissioning of the plant and environmental remediation activities will further generate wastes which need to be disposed of.

The USD50 mil amount was previously set based on the agreement that all radioactive wastes generated by Lynas will be removed from our country.

So, rather than allowing Lynas to prematurely withdraw their security deposit, the AELB must instead substantially increase the amount required from Lynas to appropriately address the long term risk and monitoring cost that our children will have to bear for probably millions of years once Lynas packs up and leaves us with their millions of tons of wastes.
For as long as Lynas’ toxic radioactive wastes remain on our soil, this security deposits must not be allowed to be withdrawn!

3. We strongly urge the MESTECC to apply wisdom and exercise their duties and responsibilities to ensure our people’s wellbeing, nation’s sovereignty and environmental integrity are protected.

4. Lynas’ operating licence which will expire on 2 March, 2020 must not be renewed!

ISU PENERUSAN KILANG MEMPROSES NADIR BUMI LYNAS CORPORATION LTD (LAMP) DI GEBENG, KUANTAN, PAHANG DARUL MAKMUR

2 April 2019

1. Kami, Jawatankuasa Kaukus Parlimen Pantau Lynas (JKPPL) ingin merujuk kepada kepada Manifesto Pakatan Harapan Janji 39 iaitu “Mengimbangi Pembangunan Ekonomi dengan Perlindungan Alam Sekitar” maka sewajarnya, penerusan atau dasar pelaburan mesti mengambilkira keselamatan dan kesejahteraan rakyat serta alam sekitar.

2. Kami sangat mengambil berat kenyataan berkenaan keputusan kerajaan oleh Menteri Pembangunan Usahawan, Yang Berhormat Datuk Seri Mohd. Redzuan Yusof pada 30 Mac 2019 baru-baru ini, yang mana kilang memproses Nadir Bumi, Lynas Corporation Ltd. (Lynas) akan diteruskan sebagai salah satu usaha kerajaan untuk menarik pelabur asing melabur di negara ini.

3. Kenyataan ini amat mengejutkan dan ternyata bercanggah dengan pendirian dan keputusan Kementerian serta termasuklah sebahagian besar Ahli-ahli Parlimen yang merupakan pembuat-pembuat dasar.

4. Kami berdiri teguh menyokong pendirian Kementerian MESTECC sebelum ini dalam isu pengurusan dua residu utama iaitu WLP (Water Leach Purification) sebanyak 451,564 tan metrik dan NUF (Neutralization Underflow Residue) 1.113 juta tan metrik masing-masingnya yang terkumpul di Kilang Lynas sejak tahun 2012.

5. WLP merupakan buangan pepejal yang mengandungi bahan radioaktif semulajadi (NORM) yang dikawalselia oleh Lembaga Perlesenan Tenaga Atom (LPTA) yang diberikan Lesen Operasi Sementara (TOL) selama 3 tahun (bermula 3 September 2016 sehingga 2 September 2019) manakala NUF pula dikategorikan sebagai buangan terjadual (Scheduled Waste) yang dikawalselia oleh Jabatan Alam Sekitar (JAS) dengan tempoh kelulusan penstoran sementara dari 1 November 2018 hingga 15 Februari 2019.

6. Kami juga sedia maklum, Kementerian MESTECC telah memberi dua pra-syarat ke atas LAMP untuk permohonan lesen/kelulusan baru iaitu; residu WLP yang mengandungi bahan radioaktif (NORM) mestilah dibawa keluar dari negara ini manakala bagi residu buangan terjadual (scheduled waste) NUF, LAMP perlu mengemukakan pelan tindakan sebelum tarikh kelulusan penstoran sementara sediada yang berakhir pada 15 Februari 2019. 7. Kami merasa amat kesal kerana kedua-dua pra-syarat ini tidak diambil serius bahkan awal Mac baru-baru ini Ketua Pegawai Eksekutif Lynas, Amanda Lacaze, dilaporkan mengakui bahawa Lynas tidak mampu dan tidak mempunyai sebarang niat untuk membawa sisa WLP yang mengandungi bahan radioaktif (NORM) keluar dari Malaysia. Pengakuan ini juga memperlihatkan bahawa janji mereka sangat bercanggah dalam Letter of Undertaking antara Lynas Corporation Ltd Australia dan Lynas Malaysia Sdn Bhd bertarikh 23 Februari 2012 dan 6 Mac 2012 yang menyatakan komitmen tersebut.

8. Sehingga hari ini, Lynas tidak dilihat memberikan komitmen dalam menyediakan pengurusan sisa yang komprehensif untuk jangka panjang. Beberapa ketidakpatuhan terus berlaku sebagai contoh, pertama; residu yang mempunyai bahan radioaktif (NORM) seperti WLP perlu penstoran di kawasan berbumbung dan jauh dari kawasan yang ada kecenderungan berlakunya bencana. Kedua, sisa berjadual (scheduled waste) yang berada di tapak tidak boleh melebihi 20 metrik tan atau tempoh 180 hari (6 bulan). Hakikatnya, residu NUF oleh Lynas kini melebihi 1.113 juta tan metrik melebihi 6 tahun berada di tapak.

9. Kami ingin memberi penegasan, kita tidak pernah menentang pelaburan asing, tetapi sebagai wakil yang dipilih oleh rakyat kita mesti mempunyai keazaman politik (political will) dalam memastikan proses pembangunan yang mampan serta tidak memberikan kesan negatif kepada kesihatan dan keselamatan rakyat serta juga kelestarian alam sekitar. Dengan ini, kami bertegas operasi Kilang Lynas tidak boleh diteruskan selagi syarat-syarat pengurusan sisanya tidak dipatuhi seperti yang telah ditetapkan.

Over the past few weeks I have watched all the drama by Lynas with amazement and amusement. They continue to conduct themselves with their kind of corporate behavior which is ingrained with colonialism mentality, resorting to corporate tactics of manipulations, enticements and threats. Profits and gains cloud minds which are devoid of a sense of humanity. We would like to send Lynas a clear message that the rakyat of the new Malaysia will not buy this sort of tactics anymore.

They even have the cheek to ask for a fair, just and transparent review.

“Were they and the previous corrupt regime who allowed them to operate in this country ever fair, just and transparent to the people?

The joint-ministerial statement issued by four ministers namely Dato’ Sri Mustapa Mohamed, Minister of International Trade and Industry, Dato’ Sri Panglima Dr Maximus Johnity Ongkili, Minister of Science, Technology and Innovation, Dato’ Sri Douglas Unggah, Minister of Natural Resources and Environment and Dato’ Sri Liow Tiong Lai, Minister of Health on 10th December 2012 (as attached), that was about three months after the issuance of a two years Temporary Operating License (TOL) to Lynas, clearly states :

1. The TOL granted to Lynas requires as a specific condition that the company removes all the residue by LAMP out of Malaysia. This include all products made from the residue. The Cabinet has also endorsed this condition.
2. Should Lynas fail to comply with this condition, the Atomic Energy Licensing Board (AELB) is empowered under Section 22 of the Atomic Energy Licensing Act 1984 (Act 304), to suspend or revoke the TOL and order Lynas to immediately cease operation.

Now, six years on, the people has witnessed a foreign company that is so powerful that they do not need to abide by a directive issued by the Malaysian Cabinet. Lynas’ TOL was not only not revoked but they managed to get their operating licenses renewed twice since then. Today, the tens of thousands of tons of Lynas’s toxic radioactive wastes are still piling up like mountains in the backyard of the 700,000 community of Greater Kuantan.

Lynas, your time was up years ago.

Some people have wondered why I have not been actively responding to Lynas’ games and cheap spins. The reason is very simple.

“Over the past 7 years, were the people not loud enough, said enough, explained enough, and our actions not clear enough?”

The rakyat has installed a new government on May 9th 2018. We are no longer in the opposition. Lynas may not seem to come to terms with this reality yet but the people must come to the realization that the government has changed. Many of those who marched or stood with me on the streets are now my comrades in parliament. And all of them still hold on strongly to the conviction that Lynas must be shut down.

As a member of the new ruling people’s government, I will do my best within my capacity to ensure the people’s aspirations are fulfilled.

So, let’s allow the Executive Committee, relevant agencies and Ministry to go through the due process. I am confident our new Pakatan Harapan government will not allow our country to be used as the dumping ground for foreign radioactive contaminated wastes and subject our people to unnecessary health risks. This government will not disappoint the millions of Malaysians who want Lynas to pack up and sent back to Australia!

MARI MEMBUKA LEMBARAN BARU DALAM PENGURUSAN PENGGUNAAN TANAH

Kebelakangan ini, beberapa kenyataan berkenaan dengan dasar-dasar penggunaan tanah kerajaan baru dalam sektor perhutanan dan perladangan sawit telah muncul.

Pada Sept 4, Menteri Industri Utama (KIU) Teresa Kok telah mengesahkan semula komitmen pentadbiran Pakatan Harapan untuk menunaikan janji litupan hutan 50% atas mukabumi Malaysia kepada komuniti antarabangsa. Untuk melaksanakan komitmen tersebut, beliau menyatakan bahawa ini bermakna perkembangan perladangan kelapa sawit akan dihentikan.

Kenyataan tersebut telah mendapat reaksi serta-merta daripada kerajaan negeri Sarawak yang menolak cadangan tersebut atas sebab penanaman kelapa sawit adalah diperlukan untuk tujuan pembasmian kemiskinan. Selepas itu, seorang felo Akademi Sains Malaysia (ASM) juga menyokong keputusan Sarawak dan menggalakkan negeri-negeri lain menolak cadangan KIU.

Sementara itu, Menteri Air, Tanah dan Sumber Asli (KATS) Dr Xavier Jayakumar pula mengumumkan satu pelan penanaman hutan dengan sebuah badan bukan kerajaan bernama Pusat Konservasi dan Penyelidikan Hutan Tropika (Tropical Rainforest Conservation and Research Centre – TRCRC). Temubual beliau oleh suratkhabar The Star juga banyak kali menyebut perkataan penyahhutanan dalam menyokong cadangan TRCRC.

Justeru itu, saya ingin memberikan pandangan dan pemantauan saya terhadap perkembangan tersebut.

1. Sebagai permulaan, saya menyokong hasrat KIU untuk menunaikan janji 50% litupan hutan di mana saya juga membangkitkan hal tersebut ketika berucap julung kali di sidang parlimen yang berlangsung baru-baru ini. Dasar ini bukan setakat memenuhi janji kita kepada komuniti antarabangsa tetapi ia juga untuk menjaga kepentingan kita sendiri. Perlindungan hutan bukanlah sekadar untuk menyelamatkan harimau mengikut pandangan sinis Felo ASM bahawa perbezaan antara ladang sawit dan hutan cuma dalam ketidakwujudan harimau dalam ladang sawit. Kita sedia maklum bahawa hutan memberikan banyak perkhidmatan yang penting untuk kesejahteraan kita – perkitaran air dan pengawalan banjir, perkitaran gas-gas rumah kaca (greenhouse gases – GHGs) dan kestabilan cuaca setempat, sumber kayu dan pelbagai hasilan hutan dan juga tempat lindungan untuk komuniti Orang Asal.

2. Istilah ‘penyahhutanan’ telah kerap disalah fahamkan . Sekiranya kita mengatakan ‘penyahutanan’ berlaku dalam sistem pengurusan hutan cara mampan (Sustainable Forest Management – SFM) yang diamalkan sejak pertengahan 1990an, ini bererti kita mengakui bahawa terdapat kelemahan dalam sistem SFM sehingga berlaku penebangan hutan secara habis-habisan atau amalan pembalakan yang membinasakan hutan. Ekoran daripada itu, kita terpaksa menjalankan aktiviti penanaman semula. Kita harus segera memahami istilah-istilah perhutanan yang membawa makna spesifik untuk mengelakkan lagi banyak kesalahfahaman dan penyataan yang mengelirukan dan membawa kesan-kesan negatif ke atas industri kayu-kayan dan minyak sawit serta komitmen negara dalam mengurangkan aktiviti pemanasan bumi daripada sektor perhutanan.

3. Statistik litupan hutan yang diumumkan oleh Kementerian Sumber Asli dan Alam Sekitar sebelum ini adalah 54.6%. Mengikut saiz keluasan ketiga-tiga daerah geografi, Semenanjung Malaysia tidak akan dapat capai sasaran 50% tersebut manakala Sabah dan Sarawak masih berada dalam keadaan yang selesa untuk mencapai sasaran masing-masing. Kadar perubahan penggunaan tanah yang tinggi di Semenanjung tidak dapat dielakkan kerana kadar pertumbuhan penduduk, perindustrian dan perbandaran yang jauh lebih tinggi daripada Sabah dan Sarawak. Oleh itu, kita memerlukan satu mekanisme ‘perkongsian beban’ untuk memastikan kita dapat memenuhi komitmen bersama tersebut.

4. Tidak dapat dinafikan minyak sawit adalah sejenis minyak sayur-sayuran yang banyak kegunaan dan memberikan hasil yang tinggi per hektar tetapi kita harus sedar bahawa Malaysia bukan lagi pengeluar nombor satu atau satu-satunya sebuah negara pengeluar. Terdapat juga negara-negara pengeluar lain dan ini telah menyumbang kepada keadaan pengeluaran berlebihan yang menyebabkan kejatuhan harga pasaran dunia. Ini telah merumitkan lagi ekspot minyak sawit negara yang ditekan oleh cabaran-cabaran kelestarian dari negara-negara pengimpot. Sebenarnya, kerajaan sebelum ini dalam Pelan Transformasi Ekonomi telahpun menghadkan pengembangan kawasan perladangan sawit kepada 6 juta hektar menjelang 2020. Perlu dinyatakan bahawa Timbalan Ketua Negeri Sarawak Dato Amar Douglas Uggah Embas adalah ahli Jemaah cabinet ketika pelan tersebut diluluskan dalam tahun 2009. Walau bagaimanapun, kita tidak harus berpolitik dalam hal ini tetapi kita harus berkerja-sama untuk mencari penyelesaian terhadap cabaran-cabaran ini.

5. Perjanjian penanaman semula hutan yang diaturkan antara Malaysia dan Norway oleh TRCRC adalah satu perkara yang agak pelik. TRCRC adalah sebuah badan bukan kerajaan yang ditubuhkan oleh bekas Perdana Menteri Tun Abdullah Badawi dan isterinya Toh Puan Jean Abdullah. Badan tersebut telah melobi kerajaan-kerajaan barat di beberapa persidangan Konvensyen Kerangka Perubahan Iklim Bangsa-bangsa Bersatu (United Nations Framework Convention on Climate Change – UNFCCC) dan mempromosikan dirinya sebagai sebuah entiti yang layak menjalankan aktiviti-aktiviti pengurangan perlepasan GHGs dalam sektor perhutanan. Saya difahamkan bahawa Malaysia telahpun menyiapkan dan menyerahkan pelan tindakan kebangsaan untuk mengurangkan pelepasan GHGs dari aktiviti penyahhutanan dan kemerosotan hutan di bawah mekanisme yang dipanggil REDD-plus (Reducing Emissions from Deforestation and Forest Degradation )kepada pihak UNFCCC, sekaligus, mengumumkan bahawa Malaysia sudah bersedia untuk melaksanakan mekanisme tersebut dengan bantuan kewangan antarabangsa termasuklah bantuan dua-hala seperti dengan Norway. Saya hairan di manakah TRCRC bercadang menjalankan aktiviti penanaman semula hutan dan kepakaran serta pengalamannya memandangkan usia pertubuhannya yang masih singkat.

Sebagai kesimpulan, saya ingin mengutarakan beberapa cadangan untuk bergerak ke hadapan.

Memandangkan kerumitan berkenaan dengan perkara penggunaan tanah, saya ingin mencadangkan penubuhan sebuah majlis penasihat gabungan tiga kementerian – KIU, KATS dan Kementerian Tenaga, Sains, Teknologi, Alam Sekitar dan Perubahan Iklim – yang menerajui agensi-agensi dan bahagian-bahagian kementerian yang berkenaan.
Majlis penasihat tersebut boleh mempercepatkan pemahaman cabaran-cabaran, menyeleraskan tindakan bersama and mengorak langkah baru dalam melindungi hutan, memastikan kelestarian industri kayu-kayan dan minyak sawit, mencapai tujuan pembasmian kemiskinan dan perkongsian kekayaan antara ketiga-tiga daerah geografi dan antara negeri-negeri di Semenanjung.

Media Statement by DAP National Headquarters on 24 August 2018 in Kuala Lumpur

Eight DAP members of Parliament led by MP for Iskandar Puteri, Lim Kit Siang, are visiting Shanghai and Beijing on the invitation of Chinese Communist Party from 24-30 August 2018 as part of the China-Malaysia relationship-building initiative following the Prime Minister, Tun Dr Mahathir's recent visit to China.

The DAP MPs are Lim Kit Siang (Iskandar Puteri), Fong Kui Lun (Bukit Bintang), Ngeh Koo Ham (Beruas), Alice Lau (Lanang), Khoo Poay Tiong (Kota Melaka), Chan Foong Hin (KotaKinabalu), Oscar Ling (Sibu), and Wong Tack (Bentong).

The delegation will be attending the Merdeka Forum organised by the Shanghai Bersih on 25 August in Shanghai where Lim Kit Siang will speak on "Malaysian Diaspora and New Malaysia".

The delegation is scheduled to pay visit to various community projects in Shanghai and will be meeting Malaysian students at QingHua university in Beijing.

Media Statement by DAP MP for Bentong Wong Tack on 11 August 2018:

No compromise to finding a solution to cyanide pollutionin industrial mining

On 9 August, the concerns of the villagers of Bukit Koman, Raub in Pahang were raised in the first Dewan Rakyat sitting since Pakatan Harapan wrested federal power on May 9.

The answers provided by the Minister of Water, Land and Natural Resources Dr Xavier Jayakumar have disappointed not only the Bukit Koman’s Ban Cyanide Action Committee but also ignited discontent among many Malaysians that have long followed the struggle of the activists, judging from the views that had been expressed on the social media.

Although the mine has since discontinued its operation, the Bukit Koman residents are still facing a cyanide contaminated gold mine with toxic residues lingering in their surroundings.
As a MP that has made environmental protection and justice as my core business, I, therefore, raised their long-standing worries and longing for a solution to make things right in the august house.

I’d also enquired if the government intend to ban the use of cyanide in the gold mining industry and if indeed the economic benefits from such commercial activities outweigh the cost of a clean environment and public health.

No doubt, the reply from the Minister was disheartening. However, as most of us are still new to the administration of the country, I would like to give the benefits of doubt to the Minister that he was not given the full picture by his officials.

Therefore, I have taken the approach to alert him (in the corridor after the session) by citing a particular misinformed fact with the intention to illustrate the importance for Ministers to verify answers provided by their respective ministries’ official.

As a government backbencher, I believe it is also my duty to work with the ministers to find solutions to our shared problems. But that does not equal to being compromised.

I welcomed the Minister’s intention, conveyed to me in private, that he would be happy to inspect the mine in Bukit Koman to gain first-hand knowledge. The Bentong and Raubparliamentary teams will certainly provide the necessary assistance for the visit should he required it.

Finally, we look forward to work together with the relevant ministries to work towards an acceptable outcome for the Bukit Koman case and the lessons learnt will be applied to ensure that the remaining three mines elsewhere in Pahang will be managed in accordance to the highest sustainability requirements.
